Mableton Man Allegedly Punched, Threw Girl, 13

He was arrested Thursday.

A 13-year-old girl complained of pain and bleeding from her right ear after a Mableton man allegedly grabbed, punched, pushed and threw her.

The incident occurred in front of a 9-year-old girl and an 8-year-old boy around 6:30 a.m. April 3 inside a residence in the 590 block of South Gordon Road.

According to a Cobb County criminal warrant, Serafin Diaz allegedly grabbed the girl by her hair; struck her in the face with his closed fist and open hand; placed his hands around her neck; threw her out of her bedroom; and pushed her into a hallway wall.

The victim had visible marks on her right cheek and in her right ear, and the hallway wall was damaged, records show.

Diaz was arrested Thursday and booked into the Cobb County Jail on charges of cruelty to children in the first degree and cruelty to children in the third degree. He was released Saturday on a $7,500 bond.

This story is mighty thin in terms of context. Regardless, he bonded out and is probably long gone by now.

is reminded to "presume innocence until proven guilty" (Matthew 7:1)

Doc, the child had cuts and marks on her face, How are you going to presume innocent?
HeartDoc Andrew April 10, 2013 at 10:26 AM
responds to Chuck as follows: It's easy to presume innocence after mndfully noting the word "Allegedly" in the title of the article

Doc, I work as a paralegal, those a mere legal terminology till a indictment is sealed and then formally charged, when the police or investigators take photo's, interview victim, and other eyewitnesses, they build their case with evidence against defendant, then there is a arraignment, plea deal and evidently jury trial which is usually if defendant still claims his innocence and proceeds to trial phase of case.

responds to Chuck as follows: You wrote elsewhere that you worked as an electrician.
