Bankhead "TRASH" Transfer Station

The Bankhead "TRASH" Transfer Station (BTS) has raised its ugly head again and has found its way back on the Cobb County Commission agenda.

The Bankhead “TRASH” Transfer Station (BTS) has raised its ugly head again and has found its way back on the Cobb County Commission agenda to be approved to accept household waste in our community.  As you may recall, the commission voted unanimously, with one abstention, last summer to deny the zoning and land use applications of the Bankhead “TRASH” Transfer Station.  The company’s attorney’s appealed the decision.  In Cobb County, all filed cases are required to go to mediation.  We were given assurances that the County would vigorously defend the decision of the Commission and that county officials would allow us to take part in or keep us aware of when the mediation occurred and what transpired.  These promises were not kept.

The mediation of this case took place in December, without the knowledge or input of our community.  Assistant County Attorney Joe Atkins participated in this mediation and agreed to settle this matter by essentially allowing the Bankhead Transfer Station to bring trash back to our community.  His negotiations also involved allowing BTS to go back to GDOT to convince them to reverse their opposition to this matter.  Documents from the transfer station’s attorney as well as GDOT are attached that will reflect what transpired.  I have also attached the 2012 GDOT letter for your review.

LegacyCare's and Shelia Edwards have begun discussions with our local, state and federal elected officials for their help.  As a community, we need to prepare ourselves now to fight this matter by all means available to us.  The first phase is letter writing to the Commissioners to request that they not allow this matter that was just voted down to come back in for a new vote.  We need to remind our commissioners that these applications were not just denied because of proximity to an airport, but also because the applications were contrary to Commission policy as set forth in various adopted Master Plans, our community already has an excess amount of transfer stations, and the negative and adverse impacts that such facility will have on nearby residential communities.   All of these reasons are just as valid today as they were when these applications were denied last summer.

Please see the attached contact list.  We ask that you begin sending letters to the Commissioners asking them to vote no to this settlement.  You can use the information in this paragraph and add your own comments as to why they should vote no.

Lastly, please make plans now to “pack” the Public Hearing at the Zoning Meeting.  We cannot rely on a few people to fight this – we need everyone.  We care about our families, our home, and our community.  We need each of the Commissioners to know this.  Please make plans now to be present at this meeting that is scheduled for February 19, 2012 at 9:00 a.m. in the Cobb Commission office.  Additional details will follow as I gather information.
